VocabularySize.com (VS) recognizes that the visitors and customers who use our various vocabulary knowledge measurement services value their privacy. Our policy is that any personally identifiable information that you disclose to VS when using any of our Services, including in particular your email address, name and any other personal information we received, will be kept confidential and be protected from use by all others.

This Privacy Policy details the use and disclosure of personally identifiable information collected from visitors and customers (collectively and individually “Users”) who utilize our Services including by websites operated by VS and other means such as by telephones and postal communications. We provide this Privacy Policy to help you make an informed decision about whether to use or continue using VS's Services.

This Privacy Policy is incorporated into and is subject to VS's Terms of Use. Your use of any VS's websites and any personal information you provide to a VS website shall remain subject to the terms of this Privacy Policy and our Terms of Use.

How VS Collects Information

User Provided Information: Users may be requested to provide certain personally identifiable information (such as your actual name, your organization name, and your active email address) to VS when responding to various questions on the VS websites.

Cookies Information: When you visit a website operated by VS, we may send one or more cookies - a small text file containing a string of alphanumeric characters - to your computer that uniquely identifies your browser. VS uses both session cookies and persistent cookies. A persistent cookie remains after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the VS websites. Persistent cookies can be removed by following your web browser help file directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the VS websites may not function properly if the ability to accept cookies is disabled.

Log File Information: When you use the VS websites, our servers may automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol ("IP") address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.

How VS Uses Information

If you submit personally identifiable information to us through the VS's websites, we will use your personal information to operate, maintain, and provide you with the features and functionality of the VS Services.

Any personally identifiable information that you disclose to VS online through any of VS's Services will be kept confidential and be protected from use by others.

We may include commercial messages and hyperlinks in the VS Services and related emails we send to you. Our Users will have the ability to opt-in or opt-out at any time. If we have your email address on file, we may use it without advance notice for administrative purposes such as notifying you of a substantial change or upgrade to our Services or websites.

To improve the quality and design of VS's websites and to create new features, promotions, functionality, and Services, we analyse Users' non-personally-identifiable anonymous response data and other interactions data related to, cookies, IP addresses, browser types, clickstream data, etc.

We use cookies and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the VS websites; (b) provide custom, personalized content and information; (c) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (d) track your response submissions.

Please note that all anonymous response and interactions data recorded in the course of using the VS Servises becomes Published Content and is not considered personally identifiable information subject to this Privacy Policy.

When VS Discloses Information

We do not share personally identifiable information (such as actual name, organization name, and email address) with any other third parties for any commercial or marketing uses without your consent.

We provide our Users' personally identifiable information only to registered Users who have created a group test and have requested personally identifiable information from the Users of that group test.

We do share Users' non-personally-identifiable information (such as anonymous response data and other interactions data, referrals to external links, applications, web pages and URLs, number of clicks, etc.) with our affiliated third-parties to assist them in researching language usage patterns and also website usage patterns for certain content, services, functionality, advertisements, and/or promotions on VS's websites.

We may release personally identifiable information and/or non-personally-identifiable information if required to do so by New Zealand law, or in the good-faith belief that such action is necessary to comply with the laws of New Zealand or international law (such as international Copyright Law) or respond to a New Zealand court order, subpoena, or search warrant.

VS also reserves the right to disclose personally identifiable information and/or non-personally-identifiable information that VS believes, in good faith, is appropriate or necessary to enforce our Terms of Use, take precautions against liability, to investigate and defend itself against any third party claims or allegations, to assist New Zealand government enforcement agencies, to protect the security or integrity of our website, and to protect the rights, property, and safety of our Users or others.

Your Choices

You may decline to submit personally identifiable information through VS's websites, in which case VS may not be able to provide certain Services to you. You may update or reestablish your personal profile information and email preferences at any time. Please note that any Published Content submitted by Users to the VS websites cannot be removed and shall remain subject to our Terms of Use.

To protect your privacy and security, we take reasonable steps (such as requesting a Password) to verify your identity before granting you access to your account or allowing changes or corrections to your profile. You are responsible for maintaining the secrecy of your unique Password and account information at all times.

Third Party Advertisers and Links to Other Sites

VS may invite other companies, called third party sponsors or ad servers or ad networks, to provide content and or advertisements within VS's websites. These third party sponsors or ad servers or ad networks may use technology to send, directly to your browser, the advertisements and links that appear on VS's websites. They may automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content.

VS does not provide any personally identifiable information to any third party ad servers or ad networks without your consent. However, please note that if a sponsor or advertiser asks VS to present an advertisement to a certain audience (for example, people ages 18-24) and a User responds to that advertisement, the advertiser or ad-server may conclude that the User fits the description of the audience they are trying to reach.

You should consult the respective privacy policies of any third party ad servers or ad networks that you visit. VS's PRIVACY POLICY does not apply to, and we cannot control the activities of, the sponsors or other advertisers and their websites.

Commitment To Data Security

VS uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to VS via the Internet and you do so at your own risk. Once we receive your transmission of information, VS makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

If VS learns of a security systems breach, VS may post a notice on VS's websites and we may attempt to notify you electronically so that you can take appropriate protective steps.

Children's Privacy

Any portions of our website that are directed to persons under 13 may only be accessed upon receipt of legal consent from the child's parent or legal guardian. If you are under 13 years of age, you must have your parent or legal guardian submit legal consent for you to use the VS website. If VS learns that personally identifiable information of persons under 13 years of age has been collected on the VS websites without verified parental consent, then VS will take the appropriate steps to delete such information.

International Users

As of the date indicated below, VS's websites are hosted in the United States. If you access VS's websites from any other country, be advised that through your continued use of VS's websites, and whenever you transfer your personal information to VS's websites in the United States, you are consenting to that transfer and to the governance of United States law regarding how VS handles your personal information in accordance with the terms of this Privacy Policy and our Terms of Use.

Merger, Sale, or Bankruptcy

In the event that VS is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from our Users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used.
